BY POSTING AN ADVERT, YOU AGREE:

1. Classifieds (Barbados) Limited is a completely 'FREE to advertise' website - until further notice. This includes any additional features: attaching photos and/or company logo and links to your email address and website.

2. We reserve the right to implement a chargeable payment structure thereafter. In such event, you will be informed prior to doing so. You are under no obligation to continue advertising with us after such time. If you have placed a free advert during the change over period, you will not be charged and your advert will run until it expires.

3. By using Classifieds (Barbados) Limited you agree to be legally bound by these terms, which shall take effect immediately on your first use of Classifieds (Barbados) Limited. If you do not agree to be legally bound by all the following terms please do not access and/or use Classifieds (Barbados) Limited.

4. Classifieds (Barbados) Limited may change these terms at any time by posting changes online. Please review these terms regularly to ensure you are aware of any changes made by Classifieds (Barbados) Limited. Your continued use of Classifieds (Barbados) Limited after changes are posted means you agree to be legally bound by these terms as updated and/or amended.

5. You are solely responsible for the content of your ad. You agree that your ad will not contain any libelous, defamatory or unlawful information and will be legal, decent, honest and truthful. You also agree that information contained in your ad does not violate or infringe upon any trademark, copyright or similar rights of others.

6. The advertiser must provide a valid email address. Note that is not allowed to use someone else's email address or phone number without their explicit agreement!

7. The advertiser must himself own the rights to, or permission to use, any photos that are used in the ad. It is also not allowed to upload photos that are not relevant to the ad.

8. Advertisers who seek to advertise goods, a service or information, in the course of a business, must make that fact clear. It is not allowed to advertise as a private seller if the selling is part of a commercial enterprise. In these cases you must register via a Commercial Account.

9. By posting your advertisement you agree that we can send you e-mail messages concerning the status of your advertisements or deemed appropriate in our sole discretion. You agree that you may time to time receive offers from us or approved third parties either by email, post, text message or telephone.

10. It is your responsibility to return to Classifieds (Barbados) Limited once your ad has been posted and verify the accuracy of the information in your ad.

11. You agree to respond to inquiries to your ad in a timely fashion and to immediately delete the ad from our database in the event the content described in the ad is no longer available.

12. Registrations from abroad can be accepted in the same way as Barbadian registrations. However, please note that we cannot accept advertisements which are not beneficial and targeted for the Barbadian community and tourism sector.

13. In agreed circumstances, either verbally or in writing, Classifieds (Barbados) Limited will input your information for you. Yet, it is agreed that you and we are independent parties and nothing in this agreement creates any partnership, joint venture, agency, franchise, or employment relationship between us.

14. While every endeavor will be made to meet the wishes of Advertisers, the Classifieds (Barbados) Limited does not guarantee the insertion, the position, or the colour of any particular advertisement.

15. Classifieds (Barbados) Limited reserves the right to omit, suspend, or change the position of any advertisement, even if it has already been accepted for publication.

16. Classifieds (Barbados) Limited reserves the right to make any alteration it considers necessary or desirable in an advertisement and to require artwork or copy to be amended to meet its approval.

17. We also reserve the right to make minor and cosmetic changes to your ad in order to conform it to the style and format we have established for Classifieds (Barbados) Limited.

18. Any Advertisement that you post using Classifieds (Barbados) Limited may be edited, removed, modified, published, transmitted, and displayed by us and you waive any moral rights you may have in having the material altered or changed in a manner not agreeable to you.

19. We endeavor to approve your ad prior to posting but we will not be held liable for any damages or lost profits arising out of or related to your posting of an ad in the Classifieds (Barbados) Limited advertising system. We take no responsibility and assume no liability for any content you post or that is posted by any third party.

20. Maintaining your privacy is important to us. Your contact information will never knowingly be revealed to anyone using the Classifieds (Barbados) Limited classified advertising system, or added to any mailing list.

21. This website or any portion of this website may not be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial purpose without express written permission of Classifieds (Barbados) Limited.

22. Classifieds (Barbados) Limited disclaim any responsibility for any actions a reader or buyer or business person may take as a result of the information posted on the Classifieds (Barbados) Limited advertising system or contained herein.

23. Classifieds (Barbados) Limited does not accept responsibility for any loss or damage caused by an error, inaccuracy or omission in the posting or printing of the advertisement, for any failure to publish an advertisement on the date or dates specified by the Advertiser, for the publication of an advertisement on the date or dates specified by the Advertiser whether the actual date be earlier or later than the date or dates specified and/or in respect of any loss or damage alleged to have arisen through delay in forwarding or omission to forward, however caused.

24. Classifieds (Barbados) Limited is not responsible for the availability, content or accuracy of any other pages or other sites linked to our website. To the extent that any of these websites contain links to outside products, services and resources, all relationships are between users and outside providers and do not involve Classifieds (Barbados) Limited, and any concerns about such products, services or resources should be directed to the outside providers. Classifieds (Barbados) Limited does not guarantee or warrant the accuracy or completeness of the information or content included on other sites, nor the quality of products or services provided or sold.

25. You expressly agree that use of Classifieds (Barbados) Limited is at your own risk. We do not make any representations or warranties of any kind regarding the Service, the content or the results that may be obtained from Classifieds (Barbados) Limited. We specifically disclaim any express or implied warranties, including without limitation, warranties of fitness for a particular purpose, warranties of merchantability or warranties against infringements.

26. Interruption to the Service: If it is necessary for us to interrupt the Services, we may do so without telling you in advance. We shall not be liable for any interruptions in Service resulting from causes beyond its reasonable control including acts of God, fire, natural disaster, war or military hostilities and strikes of its own employees. You agree that we are not liable to you for any loss whether foreseeable or not, arising as a result of interruption to the Services.

27. Classifieds (Barbados) Limited does not warrant that functions contained in it's content will be error free, that defects will be corrected, or that Classifieds (Barbados) Limited or the server that makes it available are free of viruses or bugs.

28. We may terminate this Agreement, in our sole discretion, at any time, for any reason, without notice to you.

29. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.

WIN AN IPOD PRIZE DRAW: Terms and Conditions

Prize

1. This Prize draw is sponsored and organized by: Classifieds (Barbados) Limited.

2. Entries will go into a free prize draw to win the following: Special edition IPOD Nano colour red. 8GB, holds up to 2,000 songs and 25,000 photos. Compatible with both PCs and Macs. Small engraving on the reverse reading Classifieds Barbados: Buy, Sell & Advertise.

3. Competition starts: 1st December 2006. Competition closing date: 31st January 2007

4. The closing date for the receipt of entries is midnight on the day before the draw.

Competition Requirements

5. Entry into the prize draw will be given for each advertiser that posts an advert that is placed within and specific to the Items for Sale section ONLY and for goods which are for sale (offered) and not for goods which are wanted. Adverts placed within the other categories of the site, will not be included in the prize draw.

6. You can place unlimited adverts for items for sale to be entered into the draw. Each advert has an individual order number. The more adverts you place, you increase your chances of winning. All adverts are to be approved by The Editor. Only valid approved entries will go into the draw. Please see our Terms and Conditions for advertising on our site.

Conditions

7. www.classifieds-barbados.com is a Barbadian site and unless otherwise stated all prize draws offered are open to Barbadian residents or persons who reside in Barbados only and excludes employees of Classifieds (Barbados) Limited, their families and anyone else who is professionally associated with the draw.

8. Each advert posted by the advertiser must be authentic. Classifieds (Barbados) reserves the right to view any item which is offered for sale by the advertiser. This will be a prerequisite in determining the winner. In the event that the item entered in the competition by the winner was sold before the competition ends, the winner will be expected to provide contact details of the buyer for the sole purpose of ensuring that the item which was entered in the competition was the item sold.

9. You must be the owner of the item for sale or have permission to advertise this item by the owner prior to posting an advert.

10. The winners order number will be selected at random within 48 hours after closing date and the winner will be notified by email within 48 hours. Winners will be asked to confirm their email address, password, order number and verification of the advertised item (as detailed in item 9 of the competition Terms and Conditions) before the prize is dispatched.

11. The advertiser will be emailed weekly updates in relation to the competition. Please be sure to provide a working email address so that we can contact you.

12. Winners are to be included in publicity material, and entry to the prize draw implies acceptance of this fact.

13. The winners name and photo will be posted on www.classifieds-barbados.com 7 days after the draw date.

14. Winners under the age of 16 will need consent from a parent or guardian in order to receive their prize.

15. Winners must reply to the prize administrator within four full weeks of the initial prize notification being sent. Follow up emails will be sent out in one week intervals after the initial notification. If the winner has not contacted the prize administrator within this time, then the prize will be withdrawn and another winner selected at random.

16. All information on this site forms part of the terms and conditions. All entrants agree to be bound by these terms and conditions.

17. Responsibility cannot be accepted for those entries lost, damaged or delayed in transmission. Proof of sending will not be accepted as proof of delivery. Illegible or incomplete or incorrect entries will be disqualified.

18. Prizes are not transferable. No cash alternative is available.

19. The IPod prize is in full working order when dispatched to the winner. Classifieds (Barbados) will not be held responsible for loss, damage or technical faults after delivery of such prize. The winner of the prize is responsible for any repairs, maintenance, upgrades and sourcing technical advice after acceptance of the prize.

20. The decision of Classifieds (Barbados) is final. No correspondence will be entered into.
